Cotton County woman pleas “no contest” to second degree rape of teen

Cotton County_On Monday, a Cotton County school teacher pled “no contest” to the second degree rape of a 17-year-old in 2006, and was convicted and sentenced all in the same day.  Geronimo school teacher Regina McKay was accused by one of her students of giving him cigarettes and alcohol to go to her home in Walters and have sex with her.

The District Attorney’s office says the two had consensual sex, but it’s considered second degree rape.  Under Oklahoma state law, it is illegal for high school teachers to have sex with students aged 16-20.  The Cotton County DA says McKay received a sentence of five years in prison, but she will serve only 30 days, and those will be on weekends.

McKay will be on probation for two years and must pay a $1,000 fine in addition to court costs.  She will be required to register as a sex offender, and will be required to confirm her address every three months.  McKay will be permitted to be with children only when there is adult supervision, however she will be allowed to attend her children’s school functions.

McKay resigned from the school district last September, but must surrender her Oklahoma Teacher’s License by this Friday.  She also must attend professional counseling for the next year.

Council to consider Sanchez settlement, tree ordinance

Norman city councilmembers will consider approving a $75,000 settlement to the family of 17-year-old Richard Lee Sanchez, who was shot and killed by Norman Police Officer Chad Vincent after several alleged violent crimes and a high-speed chase Sept. 26, 2005.

Councilmembers will consider the action on their consent agenda at their regular Tuesday meeting.

The tort claim was lodged against the City of Norman and the officer by Leonard Sanchez, father of Richard Sanchez.

The shooting of Richard Sanchez occurred after an escape from the Alan J. Couch detention center, alleged armed robbery of a convenience store, armed robbery of a convenience store customer, theft of a vehicle and the high-speed chase that ended on Interstate 35 near Southeast 89th Street in south Oklahoma City.

Sanchez died at the scene of apprehension from several bullet wounds. An investigation indicated that Vincent shot his gun 15 times, hitting Sanchez with 13 of the bullets.

Then-Cleveland County District Attorney Tim Kuykendall ruled that Vincent used justifiable force. But the ruling prompted many protests and criticism from several human rights organizations including the National Association for the Advancement of Colored People, the League of United Latino American Citizens and the Hispanic Action Coalition.

The settlement provides for no admission of liability by the City of Norman or Vincent.

“Because the settlement proposal provides for no admission of liability by defendants, it is recommended the settlement agreement be approved by the City Council for the purpose of effectuating settlement, resolving the issues and curtailing anticipated future litigation costs,” wrote Assistant City Attorney Rick Knighton in a memorandum to councilmembers.

The Governor’s Advisory Council on Latin American and Hispanic Affairs voted in 2006 to ask for a FBI investigation into the shooting.

Leonard Sanchez’ attorney Mark Hammons also filed a wrongful death lawsuit against the City and Vincent in the U.S. District Court for the Western District of Oklahoma.

Councilmembers also will consider a tree ordinance that would require one tree be planted at each new single-family or two-family residence before a Certificate of Occupancy is issued.

Two trees would be required for lots larger than 10,000 square feet or corner lots.

The trees would be selected from a list approved by City Forester Janay Jeanis and be at least a 2-inch caliber.

The meeting will be 6:30 p.m. in council chambers at City Hall at 201 W. Gray St.

Councilmembers will have a special session at 5:30 p.m. in the study session room at City Hall to discuss appropriating $300,000 from the general fund for workers’ compensation medical expenses and temporary total disability payments and $415,390 for court orders and settlements for the balance of fiscal year 2008, which ends June 30.

UCO launches Violence Prevention Project

EDMOND — The University of Central Oklahoma launched its Violence Prevention Project on Friday to kick off sexual assault awareness month.

“Most of us are oblivious to our environment and the dangers around us,” said W. Roger Webb, UCO president.

He said people to need to learn how to diffuse angry and dangerous situations.

“All of us have opportunities in our lives to help diffuse situations,” Webb said.

Oklahoma County District Attorney David Prater, the Edmond Police Department and other local organizations will work together to provide students with educational opportunities on how to prevent violence and to connect students who are victims of violence to other resources, including counseling.

Prater said he deals with challenges in domestic abuse complaints every day and said they are always reacting to a problem.

“Get to the problem before it happens,” he said.

Dr. Bruce Lochner, executive director of the project, said the program is funded by a three year Department of Justice grant. The Department of Justice awarded a $1 million grant that will be split among five regional universities, including UCO.

“One of the grant requirements is that we provide an educational component to all freshmen,” he said.

Lochner said the component will be included in SUCCESS Central, which all incoming freshmen are required to take.

The project will allow the university to have a VPP office in Room 113 in the Nigh University Center, which will connect students to confidential services, including counseling.

“We had the services,” Lochner said. “We didn’t have anyone to coordinate services.”

The prevention project will be available to help UCO students who are survivors of intimate partner violence and abuse, sexual assault and rape and stalking.

Lochner said they are working with other organizations, including the Edmond Police Department and the YWCA, to advocate for survivors in medical assistance, legal assistance, counseling and other services.

Southern Oklahoma group rips planned water sale

OKLAHOMA CITY (AP) - A southern Oklahoma organization is looking for support in its case against selling water from Oklahoma to interests in Texas.

The Tarrant Regional Water District in Fort Worth, Texas, wants 150 billion gallons of water a year from Oklahoma streams. The district is suing the state in an effort to get the water.

Members of the Southern Oklahoma Water Association say the district wants the water for economic development in Texas at the expense of cities and towns in southern Oklahoma.

And the association says it wants more support from state leaders including the governor, attorney general and the Legislature.

The Legislature did pass a law to prohibit water sales out of state after former Governor Frank Keating’s administration planned to sell water to Texas and split the profits with two Indian tribes.

The Tarrant Regional Water District’s lawsuit claims that law violates federal interstate commerce laws.

Bill Self’s attorney: ‘Never say never’

When asked to respond to media speculation that his clients, Kansas, Bill Self, could become Oklahoma State’s coach basketball, Tulsa attorney Stuart Campbell replied, “I never say never.”

Oklahoma County a national leader in jail bookings

OKLAHOMA CITY (AP) - A new study says the Oklahoma County jail had the fastest growth rate in the nation from 2001 to 2006 in the number of inmates booked into the jail.

The study by the Justice Policy Institute found the number of people booked into the jail grew by 53% during the five years. It also says Oklahoma County currently has the ninth highest rate among major counties nationwide of putting people in jail.

But Sheriff John Whetsel says the jail’s inmate population has fallen in the past year due to two reasons.

He says a court ruling forced the state Department of Corrections to take several hundred inmates and District Attorney David Prater is working to speed up prosecutions.

Whetsel says there are now about 2,400 inmates in the jail on a given day compared to about 2,900 a year ago.
